Alberta records and privacy laws

Alberta replaced its long-standing public-sector law in 2025 with two new acts, one for access to information and one for privacy. Alberta also has its own private-sector privacy law and a separate health information law.

Access to Information Act

In force since June 11, 2025, replacing the access part of the former FOIP Act, which has been repealed. It gives people the right to ask for records held by public bodies, including their own personal information, subject to limited exceptions.

Who it affects: provincial departments and agencies, municipalities, police services, school boards, post-secondary institutions, provincial health agencies and public libraries.

Protection of Privacy Act

In force since June 11, 2025, replacing the privacy part of the former FOIP Act. Public bodies must give notice when a privacy incident could result in a real risk of significant harm to individuals. Requirements for privacy management programs apply as of June 11, 2026.

Who it affects: Alberta public bodies, including municipalities and municipal police forces.

Personal Information Protection Act (PIPA)

Alberta's private-sector privacy law. It covers personal information that organizations handle in commercial activity, as well as personal employee information. It has been recognized as substantially similar to the federal law, so it applies instead of PIPEDA for most activity within Alberta.

Who it affects: Alberta businesses and non-government organizations.

Health Information Act

Applies to health information custodians. Since August 31, 2018, custodians must report a privacy breach that creates a risk of harm to the affected person, the Information and Privacy Commissioner and the Minister of Health.

Who it affects: health care providers and health organizations.

How Datalynk supports these requirements. Datalynk keeps records in Canada, controls access by role, keeps a history of who created and changed each record, and can hold records for the retention periods you set. Meeting a law is still your organization's responsibility. Tell us which rules apply to you and we will show you how Datalynk would handle them, or tell you plainly where it would not.

This is general information about Alberta law, not legal advice. Check the current law and your own obligations with your legal or privacy advisor.
